A cigarette manufacturer is not a physician, It is not within the province of cigarette manufacturers to prescribe for human health. The manufacturers of Spud cigarettes have never claimed that, because Spuds smoke is cooled by menthol, Spuds are a remedy for throat or nose irritation, coughs or colds.

Comments:

This ad shows an image of an otolaryngologist examining a patient’s larynx with a hand mirror beside the text, “If you have a cold see your doctor!” The ad insists that Spud has never made any health claims, and then provides examples of such health claims they have not made – “because Spud smoke is cooled by menthol, Spuds are a remedy for throat or nose irritation, coughs or colds.” This is a clever, manipulative way for Spud to plant ideas into consumers’ minds regarding their cigarettes, without making actually making claims against which people might argue.
